Legal Compliance & Responsibilities – The Sky Tour

At The Sky Tour, we take our legal and ethical responsibilities seriously. Since we operate in a sensitive industry dealing with work visas, visit visas, and student visas, we ensure that all our operations comply with Indian laws. Our commitment is to provide transparent, lawful, and ethical services while protecting both our business and our clients. Below are the key legal aspects we adhere to:

1. Compliance with the Emigration Act, 1983 (For Work Visas – The Sky Work)

We provide work visa assistance but are not a recruitment agency or an employer. This means:
✔️ We do not promise or arrange jobs abroad.
✔️ We do not hold an RA (Recruiting Agent) License under the Emigration Act, 1983.
✔️ We only provide visa documentation assistance and guidance.

🔹 What we do to stay compliant?

  • Clearly state in our Terms & Conditions that we do not guarantee jobs.
  • Operate strictly as a visa consultation service and avoid any direct employment-related activities.
  • Advise clients to verify their employer’s legitimacy before applying for a work visa.
2. Lotteries (Regulation) Act, 1998 – Lucky Draws & Giveaways

We conduct promotional contests, including:

  • Lucky draws for free visa processing
  • Spin-the-wheel rewards like iPhones and Dubai trips

To avoid violating gambling laws, we ensure that:
✔️ Every participant receives a guaranteed service (such as an e-book) in exchange for their payment.
✔️ The selection process for giveaways is transparent and based on clear rules.
✔️ The lucky draw is promoted as a marketing initiative rather than a lottery.

3. Consumer Protection Act, 2019 – Fair Business Practices

Since we charge clients for visa assistance, we must comply with consumer protection laws, ensuring that:
✔️ We provide accurate and clear service descriptions.
✔️ We do not mislead clients with false promises.
✔️ We have a refund policy in place for valid claims.

🔹 How we protect ourselves?

  • Display clear disclaimers about visa approvals being subject to government authorities.
  • Provide detailed terms and conditions on our website.
  • Respond to customer complaints in a professional and timely manner.
4. Information Technology (IT) Act, 2000 & Data Protection (DPDP Act, 2023)

Since we collect passport details, personal information, and payment data, we must:
✔️ Ensure secure handling of personal data.
✔️ Use encrypted and protected payment gateways.
✔️ Have a privacy policy explaining how we handle user information.

🔹 What we do to stay compliant?

  • We never sell or share user data.
  • We maintain secure databases to protect client information.
  • We comply with cybersecurity regulations to prevent data breaches.
5. Indian Penal Code (IPC) – Fraud Prevention

To avoid accusations of fraud under IPC Sections 415, 417, and 420, we ensure that:
✔️ We do not provide false guarantees of visa approval.
✔️ We do not mislead clients into thinking they are applying for a confirmed job abroad.
✔️ All contest rules are fair and clearly mentioned.

6. The Competition Act, 2002 – Ethical Business Practices

✔️ We ensure fair pricing with no hidden fees.
✔️ We do not falsely claim to be the “best” or “only” visa provider.
✔️ We respect market competition and do not engage in unfair practices.
